RISK WARNING NOTICE
FED FREE WORKSHOPS
Fed Free Workshops (Workshops) are located around Fed Square situated in the Melbourne CBD and include various activities supplied by individual, local businesses (Organiser). The registration page for each Workshop sets out the details of the Organiser.
You must not participate in a Workshop unless you have successfully completed the registration form for the particular Workshop.
By registering to participate in a Workshop, you acknowledge, agree and understand that:
- you have read this Risk Warning Notice;
- you are over 18 years of age, or if under 18 years of age, that you have the consent of your parent or guardian to register and participate in the Workshop;
- you agree and undertake any such risk voluntarily and at your own risk;
- neither Fed Square Pty Ltd ACN 085 731 479 or the Organiser (Supplier) owe you a duty of care in respect of any risks associated with the Workshop or your participation in it;
- the Suppliers disclaim all liability and you hereby release and hold harmless the Suppliers and its staff, contractors, suppliers, agents and representatives from and against all and any actions, demands, suits, proceedings or claims which may be made by you or on your behalf or by other parties on your behalf for or in respect of or arising out of any injury, death, loss or damage (including economic, consequential, exemplary and punitive) to person or property, occurring in the course of or in connection with the Workshop, from any cause whatsoever including, but not limited to, the negligence (including negligence that occurs in responding to any emergency, medical or otherwise, that may arise during the course of the Workshop), breach of contract, breach of any express or implied warranty that the Workshop or any associated services will be rendered with reasonable care or skill, breach of any statute or statutory duty or in any way whatsoever; and
- the assumption of risk and warning in this Risk Warning Notice constitutes a ‘risk warning’ in accordance with Australian Consumer Law and Fair Trading Act 2012 (Vic).
PARTICIPATION IS AT YOUR OWN RISK
Inherent risks are associated with the participation in each Workshop. The specific risks associated with each Workshop vary based on the individual activity.
You are warned that participation in each Workshop involves a general risk of harm that may result in loss or damage to participants including personal injury or death.
The sources of the risk of harm include (but are not limited to) impacts from equipment, wet or slippery surfaces, physical exertion, intentional or accidental contact with other participants, disparity in experience or condition of participants, acts or omissions by the Organiser, agents and employees or others involved in the conduct the Workshop, or other circumstances.
If you do not want to be exposed to such risks, then you should not participate in the Workshop.
WARNING: If you participate in any of the Workshops your rights to sue the Suppliers under the Australian Consumer Law and Fair Trading Act 2012 (Vic) if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in or on this notice.
NOTE: The change to your rights, as set out in or on this notice, does not apply if your death or injury is due to gross negligence on the Supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 (Vic) and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012 (Vic).
